Shipping Policy

General

Once an order has been submitted, please allow up to 72 hours for it to be processed and shipped (generally orders will ship out sooner than this). All orders are shipped from the Otter Distribution Center in the state of Colorado via FedEx (standard shipping) or FedEx SmartPost unless otherwise specified. No orders are processed or shipped on Sundays.

FedEx Shipping

Upon shipment you will receive an e-mail notification containing tracking information so that you can view the status of your order. Please note the following FedEx delivery requirements: A signature IS NOT required for residential deliveries. A signature IS required for deliveries to apartment complexes and commercial addresses (they cannot leave your package without a signature or they will become liable). If you are not available to sign and FedEx has already attempted delivery, you have a few options. You can either sign the yellow slip the driver leaves on your door telling him to leave the package at the manager’s office or with a neighbor who can sign, or you can call FedEx with your tracking # and give them authorization to deliver to another address. For FedEx shipments, please allow 3-5 business days (unless upgraded shipping options are chosen).

FedEx SmartPost Shipping

By utilizing the United States Postal Service (USPS) for final delivery, FedEx SmartPost is able to reach any domestic address, including PO boxes. Estimated shipping times have been provided below. Please keep in mind; these time frames include our processing period, which can take up to 72 business hours.

Return Policy

LifeProof is dedicated to bringing you, our customer, the latest technology in high quality waterproof and shockproof iPhone cases and accessories. Your LifeProof case and LifeProof accessories are covered by a full 30-Day Satisfaction Guarantee policy. All LifeProof Products purchased from LifeProof may be returned within 30 days of purchase, as described below, to ensure that customer satisfaction is made on every purchase.

LifeProof will accept returns within 30 days of the original purchase if the LifeProof Product was purchased directly from LifeProof. IF THE LIFEPROOF PRODUCT WAS PURCHASED FROM A RETAILER OR OTHER RESELLER OF LIFEPROOF PRODUCTS, THEN YOU MUST RETURN THE LIFEPROOF PRODUCT TO SUCH RETAILER/RESELLER, IN WHICH CASE YOUR RETURN WILL BE COVERED BY THE RETURN/REFUND POLICY OF THAT RETAILER/RESELLER.

Please contact Customer Service by Phone (USA Toll Free 1-888-533-0735, Direct Dial & International +1-858-810-8300) or Fax (+1-858-565-4282) or use one of the options on our Support Page to obtain a Return Merchandise Authorization number (RMA) for you to use in the return process.

You will be asked the reason for your return and you will need to provide your original order number and payment information. Accordingly, please have this information readily available. LifeProof will verify that your return is being made during the applicable 30-day return period. Once your order has been verified, you will receive an e-mail which will include your RMA number as well as instructions for the return. In no event will LifeProof accept any shipment that is sent C.O.D.

Please note that LifeProof cannot accept returned LifeProof Products in packages without an RMA number. Your RMA number must be clearly marked on the outside of the package containing your returned LifeProof Product.

RETURNING A LIFEPROOF PRODUCT WITHOUT AN RMA NUMBER WAIVES ALL OF LIFEPROOF’S RESPONSIBILITIES UNDER THE RETURN POLICY, EVEN IF PROOF OF DELIVERY IS AVAILABLE, DUE TO OUR INABILITY TO MATCH YOUR PURCHASE WITH THE RETURNED LIFEPROOF PRODUCT – SO, IF YOU SEND US A PACKAGE WITHOUT THE RMA NUMBER CLEARLY MARKED ON THE OUTSIDE OF THE PACKAGE, YOU UNDERSTAND AND ACKNOWLEDGE THAT YOU WILL LOSE BOTH THE LIFEPROOF PRODUCT(S) IN THE PACKAGE AS WELL AS ANY APPLICABLE REFUND YOU WOULD HAVE RECEIVED UNDER THE RETURN POLICY.

You must use an insured carrier service with a tracking number. Please provide us with return information when available. As part of the requirements for this Return Policy, the returned LifeProof Product must be received by us (at the address specified in the return instructions we provided you with your RMA number), in the original and resalable condition and in the original packaging. You must include a full description of why you are returning the LifeProof Product.

For approved returns, LifeProof will refund to you the purchase price you paid for the returned LifeProof Product. Refunds will be issued in the form of a credit to the Credit Card you used for the original purchase, less shipping charges (which are non-refundable except for returns made under the Warranty) and less a 15% percent restocking fee. Please allow 5-7 business days after receipt of your return for your credit to be issued. You will receive an e-mail confirmation of the credit once it has been issued.

Payment Policies for Purchases from LifeProof

Purchase using Credit Card

When you place your order using a credit card, LifeProof authorizes your purchase by verifying that your card has the available funds. Your credit card provider sets aside those funds so you may not spend them on anything else. LifeProof then "captures" or takes the funds for purchased LifeProof Products only after they ship. Please note that if your purchase does not complete for any reason, such as your card being declined by our Card Processor or your bank, the set-aside funds may continue to be unavailable for you to spend for several days, but will not be taken by LifeProof.

Purchase using PayPal

When you place your order using PayPal, the purchase amount is deducted from your PayPal-associated account immediately.

Policy Regarding Damaged Items

When you receive the package containing your LifeProof Product, please inspect your parcel carefully. If you receive a damaged LifeProof Product, notify the delivery company immediately. Do not discard any of the box, shipping label, packing material, or broken items. The delivery company must pick up the damaged goods and provide you with a claim number. You may provide us the claim number so we can follow up on the claim status - this may take up to several weeks. We are unable to send out replacement items until the claim is approved, or a payment is made for the 2nd shipment. If the delivery company accepts responsibility for the claim, we will promptly issue a refund to your credit card once LifeProof receives reimbursement from the delivery company.

Policy Regarding Backorders and Delivery Delays

Backorders

Backorders will be shipped when the affected LifeProof Product become available. Some items may require prepayment.

Delivery Delays

Some LifeProof Products in the LifeProof store may not be in stock and may have to be provided from our factory. Therefore, the shipping method you have chosen during the order process only pertains to LifeProof Product leaving our location in San Diego, CA to your desired destination. Delivery from our manufacturer to our San Diego location is sometimes unpredictable. If we become aware that shipment of the LifeProof Product you ordered is being delayed for any reason, we will attempt to contact you; otherwise the LifeProof Product will ship promptly after we receive it.

Dispute Resolution Policy

LifeProof agrees to use reasonable efforts and reasonable methods to resolve any disputes or discrepancies that arise regarding you and LifeProof. As part of the dispute resolution process, you also acknowledge and agree that you as the Authorized User or the Cardholder will not initiate any chargeback or claim procedure with our Merchant Bank or your creditor without first obtaining a special claim confirmation number from us to verify that you contacted LifeProof and provided us with the opportunity to resolve the claim or dispute, even if we were ultimately unable to provide a resolution.

LIMITED PRODUCT WARRANTY

LifeProof and its affiliated companies worldwide (“LifeProof”) warrants our LifeProof products against defects in material or workmanship for a period of one year from the original date of purchase of the product by a consumer (the “Warranty Period”). LifeProof does not warrant, and is not responsible for, any smart phone or other device made by anyone other than LifeProof. If a material or workmanship defect arises with regard to any LifeProof product, and a valid claim is received within the Warranty Period, LifeProof will (1) repair the LifeProof product using new or refurbished parts or (2) replace the LifeProof product with a new or refurbished LifeProof product. For purposes of this limited warranty, “refurbished” means a product or part that has been substantially returned to its original specifications. In the event of a defect, these are your exclusive remedies.

Exclusions and Limitations

Except for the limited warranty expressly set forth above or to the extent restricted or prohibited by applicable law, LifeProof expressly disclaims any and all other warranties express or implied, including any warranty of quality, merchantability, or fitness for a particular purpose, and you specifically agree that LifeProof shall not be liable for any special, incidental, indirect, punitive, or consequential damages for breach of any warranty of any type on any LifeProof product. In addition to and without limiting the generality of the foregoing disclaimers, the limited warranty does not, under any circumstances, cover the replacement or cost of any electronic device or personal property inside or outside of the LifeProof product.

FOR END USERS WHO ARE COVERED BY AN APPLICABLE CONSUMER PROTECTION LAW OR REGULATION IN THEIR COUNTRY OF PURCHASE OR RESIDENCE, THE BENEFITS TO THE END USER UNDER THIS LIMITED WARRANTY ARE IN ADDITION TO OTHER RIGHTS AND REMEDIES OF THE END USER UNDER SUCH LAWS OR REGULATIONS. SUCH BENEFITS MAY INCLUDE ADDITIONAL WARRANTIES OR RIGHTS RELATING TO THE PERFORMANCE OF THIS PRODUCT AND REMEDIES APPLICABLE IN THE EVENT OF A DEFECT. THIS LIMITED WARRANTY WILL BE INTERPRETED UNDER THE LAWS OR REGULATIONS THAT APPLY TO THE END USER IN ANY STATE, PROVINCE OR COUNTRY AND ANY PROVISION OF THIS LIMITED WARRANTY THAT CONFLICTS WITH ANY SUCH END USER RIGHTS OR BENEFITS IS NOT APPLICABLE TO END USERS COVERED BY SUCH LAW OR REGULATION, SO THE EXCLUSIONS AND LIMITATIONS SET OUT IN THIS LIMITED WARRANTY MAY NOT APPLY, OR MAY NOT FULLY APPLY, TO YOU.

Sole and Exclusive Remedy

Your sole and exclusive remedy for any breach by LifeProof of this Limited Warranty, and LifeProof's sole and entire liability for such breach, is, at LifeProof's option, to repair or replace the defective LifeProof Product or, if the warranty claim is submitted during the first thirty (30) calendar days of the Warranty Period, refund the purchase price of the defective LifeProof Product. Repair or replacement of the applicable LifeProof Product (including parts and labor as well as re-shipping costs) shall be made at LifeProof's expense. LifeProof reserves the right to send you a replacement LifeProof Product that is the same or of a similar style to the LifeProof Product you returned under the Limited Warranty or a substitute equivalent to your original LifeProof Product that may not be of like kind (depending on availability). Replacement LifeProof Products will be furnished only on an exchange basis. Replacement or repaired LifeProof Products are warranted as above only for the remainder of the original applicable Warranty Period.

Obtaining Warranty Service

If you wish to make a claim under this Limited Warranty with respect to a LifeProof Product, please log on to www.lifeproof.com/en/contact/, complete the form and provide the following information in the ‘Message’ field:

All of the above information is required before a warranty claim will be accepted. Once Company validates your claim, we will issue you an RMA number and shipping information from support@lifeproof.com. In no event will LifeProof accept any shipment that is sent C.O.D.

Warranty Disclaimers

EXCEPT AS EXPRESSLY SET FORTH ABOVE IN THIS LIMITED PRODUCT WARRANTY SECTION, EACH LIFEPROOF PRODUCT IS PROVIDED SOLELY ON AN "AS IS" BASIS AND LIFEPROOF MAKES NO OTHER WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFEPROOF SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF NON-INFRINGEMENT, QUIET ENJOYMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF SUCH DISCLAIMER OF ANY IMPLIED WARRANTY IS NOT PERMITTED BY LAW, THE DURATION OF ANY SUCH IMPLIED WARRANTY IS LIMITED TO THE DURATION OF THE WARRANTY PERIOD OF THE LIMITED WARRANTY AS SET FORTH ABOVE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, SO SUCH LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IF APPLICABLE LAW SPECIFIES A MINIMUM WARRANTY PERIOD THAT IS LONGER THAN THE WARRANTY PERIOD SET FORTH IN THE LIMITED WARRANTY, THEN THE WARRANTY PERIOD FOR LIFEPROOF PRODUCTS SUBJECT TO SUCH APPLICABLE LAW SHALL BE CONFORMED TO THE MINIMUM PERIOD SO REQUIRED. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

LIMITATION OF LIABILITY

IN NO EVENT, UNDER ANY CAUSE OF ACTION OF THEORY OF LIABILITY, SHALL LIFEPROOF ITS DISTRIBUTORS OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OF ANY NATURE WHATSOEVER, ARISING OUT OF THE USE OF OR INABILITY TO USE ANY LIFEPROOF PRODUCT, INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, LOSS OF VALUE OF THE LIFEPROOF PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE LIFEPROOF PRODUCT, OR LOSS OF USE OF THE LIFEPROOF PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE LIFEPROOF PRODUCT, EVEN IF LIFEPROOF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, YOU UNDERSTAND AND AGREE THAT LIFEPROOF HAS NO LIABILITY FOR ANY DAMAGE OR DESTRUCTION TO CONSUMER ELECTRONICS DEVICES OR OTHER PERSONAL PROPERTY THAT ARE CONTAINED INSIDE OR OUTSIDE THE LIFEPROOF PRODUCTS, INCLUDING, WITHOUT LIMITATION, LAPTOPS, CELLULAR PHONES, OR OTHER HANDHELD DEVICES, OR ANY LOSS OF DATA CONTAINED IN THE FOREGOING DEVICES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE AGGREGATE LIABILITY OF LIFEPROOF AND ANY OF ITS DISTRIBUTORS AND/OR SUPPLIERS SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE LIFEPROOF PRODUCT GIVING RISE TO LIABILITY. SOME STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE LIMITATIONS OF LIABILITY SET FORTH ABOVE SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
